The Ministry of Education, Science and Technology has made and implemented this guideline using the authority given by Clause (e) of Rule 192 of the Education Regulations, 2059.

Teacher Saruwa Form Nirdeshika 2081 Paragraph-1

1. Abbreviation and Commencement: (1) This Guideline shall be entitled ‘Guidelines on Transfer of Teachers, 20810.
   (2) This guide will start from the date of approval by the Ministry of Education, Science and Technology.
2. Definition: In this directory unless the subject or context requires otherwise:
   (a) “Unit” means the Education Development and Coordination Unit.
   (b) “Act” means the Education Act, 2028;
   (c) “Centre” means Center for Education and Human Resource Development.
   (d) “Regulations” means the Education Rules, 2059;
   (e) “Ministry” means Government of Nepal, Ministry of Education, Science and Technology.
   (f) “Guidelines” means the Teachers Transfer Guidelines, 2081;
   (g) “School” means a community school which is being run by receiving regular subsidy from the Government of Nepal.
   (h) “special condition teacher” means section 16j of the Act. According to sub-section (3) of the Ministry of Education, teachers who are under special circumstances shall mean teachers as determined by the Ministry.
   (i) “Teacher” means a permanent teacher working in a public school.

A teacher’s post is deemed to be vacant: If a teacher working in a post approved by the Government of Nepal and registered in the National Library (Teacher) for community schools is transferred and moves to another place or has mandatory retirement or dies or voluntarily retires or has been removed from service or dismissed according to the prevailing law. The teacher post will be considered to be vacant if it is received in the school or if a new post is added.
